These Terms of Service (the "Agreement") are an agreement between FellaHost Company Limited ("FellaHost" or "us" or "our") and you ("User" or "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the products and services made available by FellaHost (collectively, the "Services"). By using the Services, you agree to be bound by this Agreement. If you do not agree, you are not authorized to use or access the Services.
1 Account Eligibility
By registering for or using the Services, you represent and warrant that:
- You are eighteen (18) years of age or older.
- If you use the Services on behalf of another party you are authorized to bind such other party to this Agreement.
- It is your responsibility to provide accurate, current, and complete information on the registration forms, including an email address different from the domain you are signing up under.
- You agree to be fully responsible for all use of your account and any actions taken through it. Maintain the confidentiality of your password at all times.
- FellaHost uses a Firewall to protect our servers. Upon a security threat, some IPs, IP ranges, or entire countries may be blocked. FellaHost has whitelisted: Tanzania, Kenya, Uganda, Rwanda, China, USA, Japan, France, and UK.
- Any dedicated IP order beyond those provided with a hosting package may be subject to IP justification and may be denied at FellaHost's discretion.
- Service data is hosted in the United States unless otherwise stated. Access from outside the U.S. constitutes voluntary transfer of information subject to U.S. laws.
2 Transfers
Our Transfers Team will make every effort to help you move your website to us. Transfers are provided as a courtesy service. We make no guarantees regarding availability, possibility, or time required to complete an account transfer.
The free transfer service is available for thirty (30) days from your sign-up date. Transfers outside this period will incur a charge. FellaHost shall not be held liable for any lost or missing data during a transfer. You are solely responsible for backing up your data.
3 FellaHost Content
All content available through the Services, including designs, text, graphics, images, video, software, and audio ("FellaHost Content"), is the proprietary property of FellaHost or its licensors. FellaHost Content may not be modified, copied, distributed, reproduced, or exploited without express written permission. Any unauthorized use will automatically terminate your rights to use the Services.
4 User Content
You may upload, store, publish, and distribute information, text, photos, videos, and other content ("User Content") through the Services. You are solely responsible for all User Content and any transactions on User Websites. By posting User Content, you represent that you have all necessary rights to do so and that it does not infringe third-party rights.
You grant FellaHost a non-exclusive, royalty-free, worldwide license to use, reproduce, display, modify, and archive User Content solely for the purpose of providing the Services.
5 Acceptable Use
You agree not to use the Services to transmit material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You agree not to use the Services to interfere with or disrupt it or servers or networks connected to it.
6 Prohibited Content & Activities
The following are strictly prohibited on FellaHost servers:
- Illegal content or activities of any kind
- SPAM or unsolicited bulk email
- Hacking, phishing, or distribution of malware
- Hosting or distributing pirated software, music, or videos
- Child pornography or exploitation material
- Unauthorized resource usage exceeding fair share of server resources
Violation of this policy may result in immediate account termination without refund.
11 SPAM Policy
FellaHost maintains a strict zero-tolerance policy for SPAM. Accounts found sending unsolicited bulk email will be immediately suspended or terminated. You are responsible for any content sent from your hosting account or through FellaHost's mail servers.
7 Payment
You agree to pay for the Services in accordance with the fees, charges, and billing terms in effect at the time your service order is submitted. If you have a payment dispute, you must notify FellaHost within seven (7) days of the charge. FellaHost reserves the right to modify pricing for the Services at any time. All payments are due in advance of service delivery.
8 Cancellations & Refunds
You may cancel your hosting account at any time. Cancellation requests must be submitted through the FellaHost client portal or Help Desk. Refund eligibility is subject to FellaHost's Money-Back Guarantee policy in effect at the time of purchase. FellaHost reserves the right to refuse a refund if the account is found to have violated these Terms of Service.
9 Privacy Policy
FellaHost's Privacy Policy is incorporated into this Agreement by reference. Your use of the Services is also subject to the Privacy Policy, which covers how we collect, use, and share your personal information. You can view our full Privacy Policy on our website at www.fellahost.com.
10 Security
You are solely responsible for maintaining the security of your hosting account. FellaHost will not be held liable for any security breaches arising from your failure to maintain secure passwords or software. FellaHost employs industry-standard security measures to protect the infrastructure but cannot guarantee absolute security.
21 Disclosure to Law Enforcement
FellaHost may disclose User information to law enforcement agencies without further consent or notification to the User upon lawful request from such agencies. We cooperate fully with law enforcement agencies.
12 Domain Registration
FellaHost offers domain registration services subject to the terms and conditions of the applicable domain registrar. Domain names are registered on a first-come, first-served basis. FellaHost makes no representations or warranties about the availability of any domain name. You are solely responsible for ensuring that your chosen domain name does not infringe the intellectual property rights of any third party.
FellaHost is not responsible for any lapse in domain registrations due to outdated contact information. You must ensure that your contact information is accurate at all times.
13 Termination
FellaHost reserves the right to terminate your account immediately if you violate any provisions of this Agreement. Upon termination, your right to use the Services immediately ceases. FellaHost will not be liable to you or any third party for any termination of your account or access to the Services.
You may terminate this Agreement at any time by contacting FellaHost and requesting account cancellation. Termination does not relieve you of any obligations to pay fees already incurred.
14 Indemnification
You agree to indemnify, defend, and hold harmless FellaHost, its officers, directors, employees, agents, licensors, and suppliers from and against any and all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Services using your account.
15 Arbitration
Any controversy or claim arising out of or relating to this Agreement shall be settled by binding arbitration. Claims must be arbitrated on an individual basis; class action arbitration is not permitted. All decisions rendered by the arbitrator will be binding and final on all parties.
If you initiate litigation against FellaHost in violation of this paragraph, you agree to pay FellaHost's reasonable costs and attorneys' fees incurred in connection with enforcement of this paragraph.
16 Independent Contractor
FellaHost and User are independent contractors. Nothing in this Agreement places FellaHost and User in the relationship of principal and agent, partners, or joint venturers. Neither party has authority to make contracts or enter into agreements in the name of the other party.
17 Governing Law; Jurisdiction
Any controversy or claim arising out of or relating to this Agreement shall be governed by the substantive laws of the United Republic of Tanzania. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
18 Disclaimer
FellaHost shall not be responsible for any damages your business may suffer. FellaHost makes no warranties of any kind, expressed or implied, for the Services. FellaHost disclaims any warranty of merchantability or fitness for a particular purpose, including loss of data resulting from delays, delivery failures, wrong deliveries, and any and all service interruptions.
19 Backups & Data Loss
Your use of the Services is at your sole risk. FellaHost's backup service runs once a week or month depending on server load and overwrites previous backups. Only one week/month of backups are kept at a time. This service is provided to shared accounts as a courtesy only and may be modified or terminated at any time at FellaHost's sole discretion. FellaHost does not maintain backups of dedicated accounts.
Any shared account using more than 20 GB of disk space will be removed from the off-site weekly backup, with the exception of databases, which will continue to be backed up. FellaHost is not responsible for files and/or data residing on your account. You agree to take full responsibility for all files and data transferred and to maintain all appropriate backup of files and data stored on FellaHost's servers.
20 Limited Warranty
22 Entire Agreement
This Agreement, including documents incorporated herein by reference, supersedes all prior discussions, negotiations, and agreements between the parties with respect to the subject matter hereof. This Agreement constitutes the sole and entire agreement between the parties with respect to the matters covered.
23 Changes to the Agreement or Services
FellaHost may modify, add, or delete portions of this Agreement at any time. If significant changes are made, FellaHost will email all active users. Any revisions will become effective when posted unless otherwise provided. You agree to any modification by continuing to use the Services after the effective date of such modification.
FellaHost reserves the right to modify, change, or discontinue any aspect of the Services at any time.
24 Severability
If any provision or portion of any provision of this Agreement is found to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions (unless otherwise specified) shall remain in full force and effect.
25 Waiver
No failure or delay by you or FellaHost to exercise any right or remedy hereunder shall operate as a waiver thereof. No express waiver of any breach of or default in this Agreement shall constitute a waiver of any succeeding breach of or default in the same or any other term.
26 Assignment; Successors
You may not assign or transfer this Agreement or any of your rights or obligations hereunder without the prior written consent of FellaHost. Any attempted assignment in violation of this Agreement shall be null and void. FellaHost may assign its rights and obligations under this Agreement, and may engage subcontractors without the consent of User.
27 Force Majeure
Neither party is liable for any default or delay in performance of its obligations under this Agreement (other than failure to make payments when due) if such default or delay is caused, directly or indirectly, by forces beyond that party's reasonable control, including fire, flood, acts of God, labor disputes, accidents, acts of war or terrorism, interruptions of transportation or communications, or supply shortages.
28 Third-Party Beneficiaries
Except as otherwise expressly provided in this Agreement, nothing herein is intended to confer any rights in any person other than the parties hereto and their respective successors and permitted assigns. Any supplier of a third-party product or service identified as a third-party beneficiary in the service description shall have the right to enforce directly the terms of this Agreement with respect to its products or services.
29 Official Communication Channels
All communications with FellaHost Company Limited must be conducted exclusively through our official and verified channels listed below. Any communication received outside of these channels will not be recognised, acknowledged, or acted upon.

⚠️ All FellaHost official emails end with either @fellahost.com or @fellahost.co.tz. Any email claiming to be from FellaHost using a different domain is fraudulent and should be reported immediately to security-team@fellahost.com.
📞 Official Phone Contacts
💬 SMS Notifications
FellaHost contacts customers via SMS exclusively using the official sender IDs: FellaSMS and FellaHost. Any SMS received from a different sender ID claiming to represent FellaHost is not authentic and should be disregarded.
30 Accepted Payment Methods
FellaHost Company Limited accepts payments exclusively through the following two (2) officially recognized and verified payment methods. No other payment channels are accepted or acknowledged.
Secure online card and mobile payment gateway available directly on the FellaHost client portal and website.
Direct bank transfer to the official FellaHost Company Limited Equity Bank account. Account details are provided upon request through official support channels only.
For any payment-related enquiry, kindly contact us directly through an official channel listed in Section 29 before proceeding. FellaHost will not be held liable for payments made to any unauthorized account or via any unrecognized method.
31 Cessation of Service
A client may formally request the cessation (termination) of their hosted service subject to the following conditions:
- Monthly Subscription: A minimum notice period of one (1) month is required prior to cessation.
- Annual (1-Year) Subscription: A minimum notice period of six (6) months is required prior to cessation.

Cessation requests submitted through any other channel will not be accepted. FellaHost reserves the right to decline a cessation request that does not comply with the above terms.
